Anyone know about Court Judgements?

    Hi all

    A friend of mine has been done out of some money in a fraudulent and illegal manner. :( Not being able to find this person, they have heard that its possible to get a court judgement against someone so as to try and recoup the sum of money off the fraudster down the line etc....

    I was just wondering if any of you know how much a court judgement against someone would typcially cost to action through a solicitor?
    We have heard on the grapevine that 10k would be typical.However this seems quite excessive no?

    Also is a court judgement against a person the same thing as sueing the person?

    Does anyone know the overall steps around the above? i.e first your solicitor must issue a notice of motion etc...and then they do such and such...etc...

    It greatly depends on whether the amount of m oney owed is disputed. If it is a clear cut debt collection case then the cost of suing (which has at its end result the obtaining of a court judgment against the defendant) would certainly not be prohibitive.

    The steps are (generally) as follows:

    1. Issue a 7 day demand letter (very cheap)
    2. No reply to demand letter, issue proceedings.
    3. Depending on whether Circuit Court or District Court - either apply for judgment in default of appearance/defence or wait until court date passes and apply for judgment.
    4. Enforcement of Judgment (Sheriff/Instalment/Committal)

    In any event you will have to instruct a solicitor if you don't want to make a balls of it.

    Those guys are expensive! Big High Court case maybe but I would think twice about the District Court with them.

    They take on cases in the District courts all the time for the banks. I would say that Fitzpatricks and Crosskerrys have the majority of work from the banks. They never appear personally they just farm out the work to local solicitors in the locality to the district courts concerned.

    All you get with them is a fancy letterhead. You would probably be better off with a good local guy.
