Assault summons

    In January I was standing outside a nightclub, A fight broke out between 2 or 3 people (I knew one of them), As I knew the doorman and he was on his own I tried to help him meanwhile someone else had ran into the fight, I grabbed him and threw him out of the way, Unfortunately he fell to the ground but as he did one of the people Involved in the fight that I knew kicked him and knocked him unconscious.

    I made a statement to this effect. it is now November(10 months later) and I am aware this was in court already last month for the "kicker" and I had received no summons, However the case was adjourned and I have this week received a summons for assault, is this legal after all this time?

    Is it Section 2, Section 3, or Section 4 assault. Should be on the summons.
