    Hi, need a bit of advice on my position / course of action here.

    I've been working in a well known bar in Kildare for the last 7 weeks. The other day I got a call from one of the managers, which is rare enough seeing as they do most things face to face, about cutting my hours. Apparently they're over-staffed for the 'christmas period'.

    He made it clear that I should hold on to the work shirts and that I wasn't being sacked. I haven't had any problems in work and I was to grips with everything from the 2nd week in.
    Then today I received my P45 in the post and haven't had a call about it since. What's going on here? Does this happen often?

    I wasn't on a contract as such, just had the interview and the job was mine for the weekends. There was no talk of probation or anything.

    I don't see why he didn't call me in, or have a chat with me after my shift, if there was something wrong - or if they were letting me go. It's just bad form on his/their part if this is the way they go about letting off employees.

    So what's my position here? Was he with-in his rights to do this without notice?

    You get a P45 after they've sacked you, and have paid you your last pay cheque.

    I know what a P45 is syco, but I get this after them telling me I should hold onto the work shirts and that they were only cutting my hours back for a bit - not sacking me ... I even have recorded evidence of this via text.

    So I'm asking what my course of action is - because it's just pure cheek on the manager(s) part.

    Well what are you looking for here? Closure in the form of a chat with the manager? Your last paycheck? Your job back?

    I don't think they did anything illegal, their behaviour was just really bad form so you can't force them to do anything money or jobwise.

    If you want to find out what really happened, I would give the manager a call and ask.

    They want you to keep your uniform, and to come back after xmas, when it's not as easy to get people, it would seem.

    At least they've given you time to get another xmas job.

    Both.

    If they were over-staffed, as they say, the management should have forecast this - instead of leading me on with the 'we're only cutting back your hours, hold onto the shirts' bit. And I haven't received my last pay - so I'm owed for my last 10hour shift.

    Granted I was the last person they took on, but I had no formal notice, just a call as an afterthought.
    I don't think they did anything illegal, their behaviour was just really bad form so you can't force them to do anything money or jobwise.

    I'm curious about this bit - and I will be calling in later.

    You are entitled to your last paycheque, no argument.

    However what they did was perfectly legal. If you are working somewhere less than 13 weeks you can be let go without notice or reason.

    Bad form obviously. It does happen from time to time that a member of management hires someone when they're already overstaffed, but to say that they're not firing you but send out a P45 anyway is very unprofessional.

    Get the money that you're owed, chalk it down to experience and get a job in a decent bar. :)

    I see what you're saying, but the bit about him getting his P45 without the 10 hours is dodge, as they wouldn't be stating his full earnings.

    Just off the phone with one of the lads, and they're after letting off two more staff (floor staff) in the same way ... no notice, 'we're cutting your hours', keep the shirts, P45 in the post.

    I have chalked it down to experience and won't be heading back if they ask me after Christmas. And I got my pay (eventually).

    Bad management, definitely.
