    Recently my girlfriend had an accident in work which resulted in a badly broken middle finger on her left arm which is causing her considerable discomfort. A faulty slide door closed on her left hand. She is considering pursuing the compensation route. Has this happend to anybody here before and can anyone reccomend good solicitors who deal in the litigation field. How much would she expect to get?

    I looked at the Golden Pages last night and frankly I dont know what to choose. Any advice would be most helpful. :confused:

    Hi Partizan,

    you do not need a solicitor at this stage. You are legally obliged in the first instance to persue the claim through the Personal Injuries Assessment Board (PIAB). This involves filling in a form and attaching a medical report on your girlfriends injuries and sending it to them. This can be done on your behalf by a solicitor but why pay them for this? Once PIAB have your details they will contact the employer concerned and ask them if they accept liability for the accident. If they do then PIAB will make a compensation award if they deem the accident warrants it. At the award stage either party can decline to accept the value placed on the case by PIAB. If this happends then PIAB will issue the plaintiff (your girlfrend) with written authorisation to sue her employer through the courts, and it is at this stage that a solicitor needs to be engaged. If in the initial stages her employer declines to accept liability for the accident then PIAB will issue this authorisation to sue to your girlfirend.

    The value of the award will depend on the nature of the injury. The PIAB book of quantum places a value of between €12,200 and €49,100 on a fractured finger depending on the level of recovery from the injury. If there is no long term damage then the award will be smaller than this.
