Suspected Fake Memory Card

    Hi

    I bought a memory card (4gb Sony Duo) 6 days ago. It freezes up alot while playing games. I've put the games on different cards and they work fine on it. I've opened a dispute on paypal for refund. Just wondering though, I through away the packaging it came with so does this mean that the seller can refuse refund? Below is his "T & C's"

    Refund or Exchange

    - Buyer will get full refund for any reason if the period is in 7 days from the date of receiving item.

    -Refund is not available after 7 days from the date of receiving the bag. Also, refund is only given if the item is not damaged, not opened, and kept in original condition. Also, refund is only given if the unsatisfactory item is returned to me.

    - Any free exchange must be in period of 7 days since buyer receive the item. Item must be kept in original condition (no damage, not used and not opened).

    - any exchange after 7 days since receiving the item will be charged 20% of the original price and post fee of exchanged will be paid by buyer. Item must be kept in original condition.

    -No exchange is available after 14 days since the buyer receive the item.

    I guess this was bought on eBay then, in which case it's 100% likely to be fake as they all are, even though all the sellers put crap like 100% genuine in the auctions. Tell him you're going to report him to eBay and Sony for selling fakes, which I believe you can do. Definitely eBay have a no fakes policy, which is about as enforced as their no overcharging on post policy.

    You'll be liable for return post cost, which must be registered for Paypal to be able to refund you in the dispute. This could cost more than it's worth for you to go ahead.

    His terms do seem to suggest that since you've opened it he won't take it back, but how else do you determine it doesn't work if you don't open it. I think these terms refer to a change of mind rather than an item not working.

    hi jor el. Yes bought on ebay. I've bought two cards before and although I do know they're fakes, I've never had trouble with them. This time I decided to buy from a reputitable seller (I wanted a genuine card) not from HK or China as the majority if not all these are fakes. So this seller is from the UK and I paid e30 for the 4gb card. His rating is 99.4%, a powerseller with over 2500. It's only when I looked at the few negatives I've seen ppl complaining about fakes.

    I've opened a dispute on Paypal just in case.

    So if he does take it back, I only get the price of the card and I don't get refunded the postage costs I paid to receive the item?

    He should refund the postage you paid to receive it, but won't cover the cost of returning it.

    You can always contact Sony with the serial number of the card to see if it's legit...

    Yep contact Sony with all the sellers info and the code.

    If it is fake Sony will contact eBay and get the stuff removed through there VERO programme.

    If people don't complain these counterfeiters will keep getting away with it!

    I contacted Paypal and within minutes got a full refund. I should have done this the times I got a fake pen drive and dell ac adapter as well but I didn't know then.:rolleyes: and paying for shipping cost back!     How to get full refund and how to expose fraudulent eBay sellers

    *Check if the seller is still actively listing the same counterfeit items today!
    * After confirming receiving counterfeit item and seller is unwilling to cooperate for refund, you should complete the Item Not Received or Significantly Not as Described process dispute after 10 days of item closing date so that eBay or Paypal is alerted of the development of fraudulent situation. If you have paid by Paypal, you can also complete the Paypal Buyer Complaint Process to get refund from Paypal within 45 days.
    * Since you have NOT been provided with what you have paid for, it does not falls into seller's return policy of faulty product so that they can get away for you to return the fakes at your own cost. Counterfeit is FRAUD, do not settle with the seller unless the seller is paying for all the associated return shipping cost of the item. You are covered by the 90 days protection period under eBay Standard Purchase Protection Program.
    * You still own the right to provide negative feedback against the seller to alert the fraudulent situation to warn other eBay buyers to uphold the eBay values and community spirit.
    * Provided that you have provided negative feedback to the seller and if subsequently the seller provides you with an unfair retaliatory negative feedback, you have a case to lodge against the seller by requesting eBay for feedback removal to fully protect your feedback.
    * Effectively you will get your money back either from the seller or from eBay/Paypal. Most important by going through this, you have assisted the process of exposing fraudulent sellers on eBay.
    * In most countries, FRAUD is a CRIMINAL offense and injunctions may be brought against the fraudsters to prevent them from moving on under a different name after being banned. Thus, you may choose to contact your law enforcement agencies or each respective brand manufacturers in your region, to report counterfeit and provide them with your item detail and the source of the item, seller's address and contact phone number.

    Hope this helps other people caught out :)
