Victim of Liam Lawlor crash settles defamation case

    Julia Kushnir, who was in the car which crashed killing ex minister Liam Lawlor has settled her case against 5 Irish papers on the steps of the high court this morning. No mention of costs etc but the papers have had to dig quite deep by the sound of it.

    I thought this was unfortunate and lucky in her case, unfortunate that it happened at all to her, but I mean by the time her name was printed the prostitute story was dropped, it was at first, young girl in car with politician...but did really ever say prostitue and her name in the same article... I guess it was still the same women and you have reason to take offence but I don't think it was quite that direct

    I think that certainly she should have lost the cases on any paper that led with "teen prostitute". The information so obviously didn't refer to her that I don't think you can reasonably argue that her character was damaged.

    Well if the female in the car was identified by the media as a prostitute and she was known to be in the female in the car then of course it did.

    You only have to prove your character has been damage in the eyes of one person to prove you have been defamed.

    Yes, one "right thinking" member of society, whatever that means.

    If one person knew that this woman was the female in the car and then believed she was a prostitute based on media reports, she'd be defamed in their eyes.

    The newspapers obviously realised just how straight forward this case was, otherwise they would have fought it.

    there few more articles about this in regard to asking how the whole cock up happened, the polish lady asked for the internal report the paper did on itself but they refused as it was going to court but they settled so it wasn't debated in court.

    VB and others had articles saying they case wasn't that strong because of the lack of direct connection between the supposed prostitute and actually woman, but that the paper settle in order to keep schtum about their investigation in order not to put light on how they operate.

    Ms Kushnir (who is Ukrainian) had lined up plenty of witnesses to show she had a strong connection to Ireland.
    She was an interpreter who specialised in working with Irish businessmen, so I think it is fair to say reputation was lowered in the eyes of people with whom she had a relationship - here in Ireland - as a result of those articles.
    What I want to know is why was none of the people involved in this sacked?
    It was an absolute disgrace, yet one of the Sindo people has now got a plumb job in the Indo. That's a scandal.

    well a number of articles were written by people highlighting that the report hadn't been see the light of day, im not sure if kushnir has seen it now.

    I always wonder why people settle, would it not have better for everyone to discuss what happened in court.

    same with the chinese blogger Vs yahoo case, they settled that to. sort of let yahoo off the hook.

    there was little to embarrass her , would it not be more embarassing for the newpapers
