    Thanks.

    Anybody seen a moderator about?

You can't offer to sell illegal copies of copyright materials on this forum, and you shouldn't do it outside of this forum either.

I presume there was an offer of illegal copies of such material offered which was subsequently edited. As johnnyskeleton mentioned, that is breach of IP rights and obviously illegal so any such posts will result in bannings from legal discussion. We have sanctioned private sales of original material but that is as far as I am prepared to allow transactions to go on this forum.

    What nonsense are you talking??

I only want to buy notes somebody else bought or paid for, and no longer need. As it happens, I can copy an entire legal text and use it for my own ends, so long as there is NO PROFIT involved. Even if money changes hands, the absence of a profit will suffice for the purpose of maintaining propriety.

Even if I was a Del Boy, I would be a damn sight more secretive.

Ah, no you can't actually.

The existence or absence of a profit or a profit motive is irrelevant in the event that you are copying an entire text. There are exemptions for fair dealing and private study and research which are applied as a matter of discretion in instances of alleged infringement. Under the Copyright and Related Rights Act 2000 examples of these are as follows:

    > Chapter of a book
    > Article from a periodical

If you're doing a bit of study for the FE1s or any law exam it's always a fairly good idea to actually check the law rather than just relying on something someone said. That if "I don't make a profit it's ok" thing has been knocking about for ages but its not true!

Ah But you can ............But maybe I cant.!

Section 42 of copyright act (5)

For the purpose of this section, where lending by an establishment to which members of the public have access gives rise to a payment the amount of which does not exceed that which is necessary to cover the operating costs of the establishment, there is no direct or indirect economic or commercial advantage.

    (4) The making of a copy of a work available between establishments to which members of the public have access shall not infringe the copyright in the work.

We copied large chunks of legal texts during College and were of the understanding that provided we used the copies for research purposes that we broke no law. Often the text was copied from a book already paid for and in private ownership There is a place in the Montrose shopping center that will do it, quite happily.

Ever heard of a thing called a library Pirelli? Sounds to me like that exemption is there to cover them charging for photocopying cards and lending rights rather than copying entire texts verbatim. As for there being places where staff are happy to copy entire texts I probably know as many as the next person but that doesn't mean that they are acting within the law.

I'm not trying to be awkward just stating the facts, people do all manner of things which are actually in contravention of IP rights and the fact that they are rarely if ever enforced doesn't mean that there is any less of a contravention. Purchasing copyrighted material doesn't give anyone carte blanche to freely violate the rights of the person who owns that copyright.

Is there a need to get patronising , That quote was direct from the copy right act 2000 contradicitng your earlier post. I wasnt contradicting you the copy right act 2000 was. In fact I excused myself from your dispute on the matter by not attaching myself to the passage of the copy right act I quoted. Please treat me with respect and courtesy notwithstanding anyother issues.

Sorry - didn't mean to be patronising but can see how it might have come across like that. Sorry
