buying a car, privately - my rights

    can anyone please help me,

    last weekend my partner put a deposit of 500 on a van, he was supposed to collect the van on friday night, but last night he got a phone call from the man who was selling it to say that he was driving it and the head gasket went and it has to be replaced and it is in the garage being fixed now.

    i rang a mechanic friend of mine and he said that once the gasket goes the van is fecked and it would not be worth my while buying it, as it will give me a lot of trouble.

    we put the deposit on the van, after test driving it and being told it was in perfect condition, it is not my fault the gasket went,

    the chap who was selling the van has said that he will not give us the deposit back as its not his fault the gasket went, im really annoyed by this, fair enough if we had of got the van last week then it would be our problem but we didnt get the van last week and the gasket went when the seller was driving it.

    are we entitled to our deposit back ???????

    any advice would be greatly appreciated.
