Returning goods - rights/ obligations of store

    This got me thinking.

    The wkend before last I bought a polo top. Put it in the wardrobe until last night, when after taking it out I discovered two small stains on the front of it.

    Couldnt return it myself, but someone else brought it back fro me today. Just got a phone call saying that they refused to give a refund, only credit notes after seven days cos that is store policy.

    I'm obviously not happy!:mad: I'm put on to someone from the store and let my feelings be known; all I want is a replacement top or a refund. My understanding is that once the top was not in a saleable condition I should be entitled to one of those two, and seeing as there was no other top in my size I wanted the refund.

    Long story short, he relented and said I can have my refund, but that normally I would have to accept a credit note. Problem solved, but just curious as to where the law stands on this? Does the SoGaSoS Act 1980 have any application? The top was not worn, tags etc still on it.

    Another thing he said when I pointed out that the top was not up to standard was "how am i s'posed to know that? how do i know you didnt put the stains there?"

    Were they banana stains? If so, you could have an evil monkey in your wardrobe.
