    Should one have obrained an item which was counterfeit then upon realising that it was, should they return to the seller before they get reinbursed ? or after ?
    eg dodgy kit on ebay

    That's not really a legal question, you might want to post in consumer issues.

    Generally, a citizen's duty, upon realising that goods are of illegal origin should be to refuse to purchase, possess or handle the goods, and contact the gardai if sufficiently serious, or else a trade association (e.g. Microsoft have their own counterfeit division, there is a pirate dvd confidential line, the ODCA etc).

    I should add that not all cheap knock offs are illegal, it's a complicated area, especially when dealing over the internet (and subject to different laws).

    well Im getting it sorted my only fear is that he does it again. I get a refund but he doesn't get any sanctions.. that said I alerted the manufacturer..

    Well such a hypothetical ebay user could leave hypothetically negative feedback on the hypothetical seller's hypothetical feedback page.

    said user could if said user had figured it was fake when he got it rather than a month later ...
