Plank Kenny - Land Thief?

    A High Court judge describes as "highly acrimonious" the dispute between Pat Kenny and his neighbour over a strip of back garden. Kenny is claiming "adverse possession" over the lands having installed electric gates, while the neighbour also claims ownership as he has the deeds.

    Remind me again, how much is Kenny paid p.a. courtesy of the tax-payer, and what's it worth to have such bad relations with your next-door neighbour? :confused:

    A dispute between broadcaster Pat Kenny and his neighbour over a piece of land has been described by a High Court Judge as highly acrimonious.

    The dispute between the neighbours centres on the ownership of a valuable piece of land in Dalkey, Co Dublin.

    Broadcaster Pat Kenny and his wife Cathy claim they are the rightful owners of the rocky outcrop, but their next door neighbour Gerard Charlton has gone to the High Court claiming he has the title to the property.

    The court has made an order allowing for the land to be examined by expert witnesses for Mr Charlton, ahead of a full hearing of the case.

    Mr Charlton says that in 1971 he and his wife acquired a leasehold interest in the land, known as Gorse Hill, close to his home.

    But Pat Kenny and his wife counter claim that they have acquired a beneficial interest in the property, which also lies beside their home.

    The Kennys say they have carried out fencing and gardening works on the land and they say the property is part of their garden.

    Mr Kenny says he locked the property from public access 16 years ago and it has been inaccessible since then except by scaling a cliff.

    Mr Charlton says he had permitted the Kennys to use the land since they came to live beside him in 1988.

    Mr Charlton claims Mr Kenny refused to give him the code for a new electric gate and sought to prevent him gaining access to the property.

    The court has heard that the Kennys dispute Gerard Charlton's claim of ownership of the property and say they have acquired it by adverse possession.

    Mr Justice Frank Clarke said there is a high degree of acrimony between both sides in the case and there has been little or no constructive engagement to resolve issues.

    At a later date the High Court will be asked to rule on who owns the disputed piece of land.

    In the meantime the judge says he will allow Mr Charlton's solicitor, a horticulturalist and an architect inspect the property to study the planting and building works the Kennys have carried out on the land.

    In fairness to RTE, at least they reported both sides of the story.

    As for the rest of it, I couldn't really care less.

    What a PxxxK, if you didn't pay for it ,it is not yours. What a tight git. If Kenny wins does that mean that someone can enter your home while you are out and give it a lick of paint and lay claim that it is now there's seeing that the cleaned it up and made it better. I hope he looses.

    technically, I think Pat does have some kinda squatters rights.

    although, then again, when the other guy has the flipping title to the land, that shouldn't mean diddly.

    kenny is really really stupid if he thinks he now owns the land, he practally stole it and i hope he gets sued up the chocolate highway for it, never liked him anyway :P

    i dont get it why is pat kenny even on the tele hes absolutely brutal! ive never heard anyone say he was a good presenter hes got no charisma, no energy and frankly bores the bollocks out of me...thankfully i dont watch the late late show :D

    I think Pat and the wife probably aren't too happy with their solicitor and barrister at the moment.
    If they do win(which I doubt they will) they probably won't get some of their costs on account of the way their representation acted so far.
    They really should have paid more attention to the fact that Pat Kenny was a "public personality" before being so down right difficult with the other side; this private dispute is affecting his livelihood.
    It appears this is the view that is held by the the judge too.

    If Pat The Plank wins, then I think we'll have another case where someone i.e. his neighbour, tries to crash his car into the RTE studios when the Late Late Show is on. He should use a Humvee, might have more success than his predecessor.

    Folks, Hammerhand there is a returning banned user.
