Stamp Duty on a Letting Agreement

    Hi All,

    A friend of mine has recently moved into an apartment at a monthly rent of €1,800. Part of her rental agreement stated that the tenant was liable "to pay any stamp duty chargeable on the original and counterpart of this agreement".

    Would anyone know what kind of stamp duty liability this would give rise to for the tenant?

    A lease for an indefinate term or not exceeding €19,050 per annum is exempt. A fixed term lease is liable to stamp duty.

    It's a one year lease at €1800 per month - so I presume it is a fixed term lease @1800*12=€;21,600?

    in that case stamp duty is payable on the lease at 1% of the annual rent. There are various rates for premiums. Most landlords don't know about it and so don't charge it. There is an excellent handout on ww.revenue.ie if you need more info.
