Help, Don't know what to do

    I bought a wedding ring on ebay from US and ordered it in my size. The seller sent me an email asking 'was it ok to send it in a smaller size as they had it in stock' and then posted it in that size without waiting for my reply, saying I could get it re-sized over here. So, I replied saying how they had no right to do that and I would either be looking for a refund of the cost to get it re-sized or I would return the ring and expect them to pay the postal fees. But they ignored the email. . . . . So the ring was delivered and I was charged custom duty on it. So what do I do now. If I return the ring do I get back the money I was charged by customs? What would you do?

    Resizing a ring is very common and is not all that costly. I had my brand-new wedding band resized three times 2 months ago as intially I had cold hands when I tried it on (was too large), the next time I had warm hands (too small) and finally it needed adjustment by half a size to get it right...!

    But, in saying that, they should have waited for a response from you. You will not receive a customs refund if you return it.
    Anyhow, get an estimation on the cost of the resize and then make a further decision.

    Thanks for the reply. So I can't get a refund on customs.

    Its the fact that I bought the ring on the basis that it would be sent in my ring size and they went ahead and posted it in the smaller size because they had it in stock, even though I sent 2 emails with my correct ring size. I don't see why I have to pay to re-size a ring that should have been sent in the right size. If the smaller ring was was being sold I wouldn't have bought it.

    Yeah, I agree. It does not fit the description of what was being sold and you were not given an appropriate opertunity to respond to the vendor's question.

    Check their contract and enter negotiations with them. You may find that they will be willing to compromise without you having to spend more cash. Document the event day-by-day for them...

    Just to update. I contacted the revenue and I am entitled to a refund of custom duties. So the ring is going back.

    Did you pay by PayPal?

    If you did I would recommend you do not send it back yet! First file a Significantly Not as Described buyer complaint through PayPal and wait for instruction from PayPal to return the item.

    If you just send the item back to the seller now without the dispute you are relying on him to refund you - and if they have not stayed in contact with you then that is unlikely.

    If you do feel the need to return it immediately make sure you use a postal method that can track delivery of the item to the seller online, you will need this should you need to file a buyer complaint with PayPal.
