Faulty Car

    My brother bought a car a couple of weeks ago from a car garage,or so he thought. When he went to view the car it was in the forecourt, car garage stickers on it, everything to indicate that it was for sale through the garage.The car was even on the garage website as being for sale.When he went to close the purchase, he went to the garage to buy the car, hand over the cheque and take ownership. Since then there has been trouble with the car, mechanical problems that are very expensive to repair. He contacted the man that sold him the car and he said that the sale was not through the garage but a private sale.

    Where does my brother stand here? What rights does he have and how can he approach this situation to achieve satisfaction?

    You are covered by the sale of goods and supply of services act 1980. The car was sold as part of a business as it was sold by a person that normally sells cars (an employee of the garage I presume?) and was sold from the premises. The guy is talking ****.

    How much did he pay for the car?

    Edit: just thinking now - im not sure. Was the car fine when your brother got it?

    What does the bill of sale say?
    Did he get a warranty?

    What paperwork if any changed hands?

    You say he went with a cheque! did he make the cheque out to the garage or to an indivudal?

    If the cheque was made out to the garage, then it proves it was sold throught the business. In these cases playing nice usually does'nt work and only wastes time. Get a soliticor and get him to write a letter to the garage, after that if you get no response get him to turn up the heat on the owner. Usually if you do not get a prompt response the first time you raise the problem with the garage it will only get worse over time.

    Cheque was made payable to individual. Not sure what paperwork changed hands. Couple of invoices for work that was done on the car, all made out to the garage name.Car bought from fore court, all usual stickers, reg plate inserts etc. Dont think he got a warranty, not sure though.

    Who was the cheque made out to? Whoever he made the cheque out to is the person (or business) that he should be chasing up

    If the cheque your brother wrote was to an individual rather than the garage, then it looks like a private sale. Was he not made aware of this? If he wasn't, why on Earth did make a cheque payable to anyone but the garage? (there is a difference between making a cheque out to Joe Bloggs and to Joe Bloggs Motors). Does he have an invoice? A receipt with the name/signature of the recipient?

    This all sounds well dodgey to me................

    Some business' may be an individual under a trading name (Joe Bloggs trading as Dodgy Motors Ltd), so a cheque may be made out to Joe Bloggs rather than Dodgy motors Ltd.

    If it was sold by a regular salesman from a regular forecourt, then it is reasonable for the customer to assume that they are buying a car from a garage with a warranty, unless they are explicitly informed that the car is a private sale at the time of the sale. Also, if the garage have worked on the car under warranty, then a warranty can be seen to exist.

    Did your brother drive the car from the forecourt, or pick it up elsewhere, even from the road outside?

    Seek legal advice.
