The BCI are apparently threatening to "regulate" Sky (which they actually can't), which would include control of EPG allocations - such as how 101-5 are provided in the UK.

Apparently the BCi's legal advice is they can regulate sky.

Slight problem is it originates from the UK, though...

Oh well, if they can regulate it, all the better.

It seems that the BCI just want to regulate the EPG, from the Sunday Business Post:

It could be argued it originates in Luxembourg too at Astra hq. From what I understand comreg and to a lesser extent the EU are looking at regulating broadcasters from within the market they are aimed at rather than the point of origin. Guess the lawyers will have to work this one out.

From the article mentioned above "The BCI has identified a clause which suggests that EPGs should be regulated in the local market."

If comreg are correct I wonder will they ask for UTV to be given an epg listing?

Origination = uplink under TWF rules. Only 1 transponder isn't uplinked from the UK.

Fair point but as I said the emphasis on EPG listings is local regulation regardless of the point of origin from Comregs current interpretation.

maybe with the much-vaunted all ireland economy, they could force sky to include UTV on the EPG (and to give us equality with our Norn brethren, the digital BBC channels as well).

Realistically in this scenario all UTV have to do is create a channel called UTV ROI or similar to be on a par with ch6

I like the way that article got their facts wrong (Channel 6 are no longer @ 223 on EPG)

TBH I'm not worried where channels are on the EPG, if i want to watch it i stick it into the favourites... I'd prefer to get the ITV's and BBC's onto the EPG instead...

I wish the BCI would regulate the dross out of the sky epg and move it to the 800's.
I know you can do it via favourites but not everybody uses that.
Most people by default use the main channel guides.

I generally use the favourites (though it is not as useful as it could be) - the EPG is way too cluttered.

ITV and BBC on the EPG would be great - for one thing you'd be able to record them on Sky+. Failing that they should allow us to add "other channels" to the favourites.

This from today's Sunday Business Post -

    "New code for digital listings
The Broadcasting Commission of Ireland has published a new code for electronic programme guides which will regulate on-screen programme information given by digital and satellite television operators.
The launch of the regulations follows a dispute between Irish commercial station Channel 6 and Sky Digital over the station’s ranking on the Sky guide system. While RTE and TV3 are the top stations on Sky’s guide in Ireland, Channel 6 has been given a much lower number, making it less easily accessible to viewers."

so the bci are gonna make sky include utv in the epg? will sky even bother complying with the bci or will they just ignore it and say take us to the high court in london if you want us to comply as were are a uk based company?

If it comes to legal action they go after Sky Ireland.

That document states that no one can make an epg available in ROI without a contract with the BCI-thats in the 2001 legislation.
That means that the BCI can already regulate sky in that it could make them stop making an EPG available to ROI customers altogether.
That would have serious implications for SKY's business in Ireland.

Latest twist in this, according to today's Tribune, is that Channel 6 are taking a complaint to Ofcom on the basis that RTÉ, TV3, and TG4 shouldn't have priority in the ROI EPG, but that the UK PSBs should!!!

Channel 6 are not comparing like with like. They are not a public service broadcaster (in fact they broadcast practically no Irish originated programming) and have no more entitlement to priority than any of hundreds of UK channels which are also not public service broadcasters.

You're right - they aren't, but then TV3 whilst holding a PSB contract broadcasts too little Irish content. Channel 6 have never said they intend to broadcast much in the way of Irish material - but I'm sure they will work to it.

I think it should take slot 105 on the epg. And I think that RTE is being taken for a ride by not having their stations grouped together properly.

Why aren't the RTE and Newstalk on 0101-0106 ??

Since Sky is not originated here all Sky have to do to stop BCI regulation is have an International version of EPG or UK only versions.

Sky is no more an Irish Broadcaster than Canal+, Digitalb or Art.

NO but sky is actively marketing and selling it's service here so they should come under some scrutiny...
