Copyright infringement

    Anyone know where in the the labyrinthine mess that is our collection of laws is the bit that says "that shalt not infringe copyright?"

    One of my photographs has been used without my permission in a commercial venture by someone I know and the matter is somewhat complicated by how the photograph has already been used (with permission) in a similar commercial venture so I want to issue a little reminder that is not totally obnoxious but which makes it clear that they are completely in the wrong. Suitable pointers in the relevant legislation would be useful.

    The story is complicated by personal links and a lack of written releases so my hands could be a little tied. I don't want compensation - I'd prefer the photograph just wasn't used but for various reasons that could be complicated. Anyone who wants the whole story should a) know me well and not be idly curious and b) PM me.

    just write a letter stating "dear sir or madam, I notice that you have used one of my photographs in your paper/article/leaflet etc dated xxyyzz. I have not given you permission to do so and therefor you are breaching copyright.


    alternatively get your solicitor to do it

    Also, thanks for the comments about the photographs. I'm always glad to hear people like them.

    Spyral - the image is used on a commercial website and although this shouldn't be the case, the matter is complicated by personal relationships.

    Caliana I know its not that simple, it happened me before about an article I'd written. In the end all that happend was that my name was removed from it.. really infuriating that people are so disrespectful and what's worse is when they pass it off as their OWN.

    Send a C&D from a solicitor and attach a personal note.

    This happened me in the past, where somebody in the USA who copied web-graphics, I simply wrote an email advising them that they could either send $200 as payment for the graphics or remove them within 7 days.

    Needless to say they were removed same day with a big apology !

    If it continues more than 7 days I would have asked for a solicitor to send an letter, this usually firghtens them enough to speed up the process.
