As far as I can estimate from the description I was given this picture of mine is in the Drogheda Independant (louth paper) for the band 'Fever Pitch' who do a fair bit of gigging. But they forgot to tell the paper my name -.-

Should I write a letter stating "hello you used my picture and this is my name please be nice and tell people it was mine" or something to that effect. ?

I've not yet gotten the paper I only heard while I was at their other gig last night has anyone else seen it either ?

Yes. If you don't get a satisfactory response, stick a turd through their letterbox.

Local newspapers rarely if ever give credit to photographers. The paper you mention has been, notoriously, trying to introduce a practice where the reporters take the photographs. There is war in the photographers section of the NUJ over it. I'd get on to them, if only to annoy them!

then hit em with the turd in the letterbox... BAM! Awww yeah.

Get used to it. Currently not getting on with the local rags myself.

oh shizer ! I never thought of that...

Additionally why don't they - I thought all pictures had to be accredited to those who take them ? Isn't it common decency ?

Do you think I should mention the thing about them being evil to photographers or just say "dear sir, on page x of last weeks paper the picture of Fever Pitch was taken by me but my name was not given. yours sincerely joe " ??

Assuming you still hold the copyright to the image and haven't permitted this use then the newspaper use is in breach and you should send them a bill.

If not (e.g. if you assigned copyright to the group or licensed the image for this sort of use) then you need to consider whether you should make a suitable credit a condition of your licences / assignments.

Usual disclaimer - this does not create a lawyer client relationship nor is it intended as comprehensive legal advice on your particular situation.

Papaers rearely use the caption you provide, they use it as a guide. I've had mine in the fingal indo, and one in cork too (mind has gone blank about the name) and herald AM I tihnk it was, got credited for all

naw I said that tehy could use it for themselves. considering the article was about their next gig it was OK. that siad if the paper had blagged it off them and then just wrote a review of a gig that they CBA in doing..

Im not to fussed as it seems they dont give the name of ANY of the people who take their pictures for that paper ah well...

    still IM IN A PAPER!

A local rag - the "Imokilly People" - printed a couple of photographs of mine without attribution, let alone payment. The lack of payment didn't worry me but the lack of attribution was annoying. Especially as they also published an accompanying article I wrote. So, at midnight in the middle of an ancient forest, I performed an occult ritual to bring the curse of The Ancient One on their heads. It worked. Three weeks later the paper went bust. Heh, heh.

    Don't fark with Carrigman!

Your website does say "Photos are (C) for commercial purposes": did they have permission to use the picture?

Slightly OT, but what's the form with getting access to venues for band shots (particularly the larger Dublin venues)? If you're not NUJ how do you convince them you're not just trying to blag a freebie gig?

the band did for advertising/promotion/website etc seeing as the article was about their next gig and was basically advertising i dont mind but it just wouldabeen nice ya know ?

ask the band is the spirit store policy as best I can tell
alternatively "Im a student of photography (aren't we all ;) ) and was wondering if I could take a few pictures.." could work either..

Ahhhhh.... I have to look forward to dealing with this paper on a weekly basis from mid september! Sports sections for the kids football. Lucky me. :(

dink I guess the next question is will you be a photographer only or will you be a writer with a camera phone.. ? (remember the latter will cause people here to decapitate you!)

Its also one of the worst photos I took to be honest.. that said its one of only about 2 of the whole band... ah well..

    shall we move on ?

Well you see... this is where I thought I was thinking for the future!!! Just a write up on the Matches each week is all thats required at the moment. But in my naive head, I thought it would be a good road into maybe sending in the odd pic in the hope that they might publish it. Not a chance it seems!!! Ah well....

Amazing the amount of people who give pics to the papers for free.

And then **** like this happens... using the photo on a story of something that apparently happened on the other side of town, worse still it looks like a person in the story had taken the pic...

i used to contribute to two local papers mostly event/wedding stuff eventually it turned out that sometimes they'd ring me asking had i any pics of something obviously because their guy had not gotten any keepers or wasn't there or whatever - course like a lot of places they're a bit shy when it comes to the subject of money - i only submit wedding stuff now for free everything else is for moolah!

    :)
