Legal question about that guy who was killed in Sandymount.

    I'm curious about something to do with the case of that Dublin guy who died after being stabbed in Sandymount. http://www.rte.ie/news/2007/0806/spellman.html

    The RTE story says "Dane Pearse, with an address at Londonbridge Drive in Irishtown Dublin, was charged with serious assault and possession of a weapon at Dublin District Court this morning."

    Now it seems to me if you carry around a knife, stab someone in the chest with it and kill him that is murder. Is he likely to be charged with murder? I mean this Pearse guy headed up the road after him, so it's hardly spur of the moment anger.
