Legal options with person refusing to pay car damage costs?

    Hi,

    About two months ago my wife and I were driving in our local town when we stopped at a T junction behind a van. The oul fella driving the van spotted a group of young girls on the corner who he knew and proceeded to call one of them over ans started talking to her. As this was happening, he never put on his handbreak and rolled down right into us. We were by no means up his arse or anything, and the van had a good bit to roll before hitting us, but the gobsh1te never copped he was moving. By the time we noticed, beeped him, and started getting the car into reverse it was too late and our bumper was cracked through.

    Initially the guy was fine about it, we got his insurance details and went on our way. A while later we got a new bumper fitted for €250, and we've been chasing the guy ever since, but he won't pay up. He initially said he had contacted his insurance brokers and they were dealing with it, but when we contacted them, they said he had mentioned it to them but had never put in a claim. Last week we spoke to him and he agreed that he'd pay the €250 himself to our mechanic. He still hasn't done this and today when we phoned him he said he checked with his insurance again and they would only cover €150 of the cost if he made a claim, so he's only willing to pay us the €150 and not the €250.

    What are my options here?

    take him to the small claims court if you are worried about the money...
