Car removed, is it illegal?

    I had a car which was currently off the road parked adjacent to my house, in communal car parking spaces.

    This car had been there for the past 2 months as I have been working on repairing it myself. There was also another car which had been abandoned next to mine. When I arrived home from work yesterday evening both of these cars were gone. I immediately reported it to the Gardai in Balbriggan who referred me to Fingal CC's abandoned cars department as I suspected it had been towed.

    When I contacted Fingal CC they informed me that they are not responsible for cars in the estate and therefore would not have removed it, they say the management company would have been responsible for this. The woman I talked to mentioned that she had taken calls in the past about abandoned cars in the estate and told the people to contact the managment company.

    So far I cannot get any contact details for the managment company.

    I rang the Gardaí again after this and they seem to be more interested in letting me make my own inquiries that giving me any help in the matter.

    As far as I'm concerned my car + its contents have been stolen, but I have a definite line of enquiry for the Gardaí to pursue.

    Any suggestions?

    Ring them back and ask to speak to the member in charge. They are obliged to take your report and investigate the matter.

    was your car fully insured and taxed etc? where the reg plates on it? if the plates where on then they have no right to move your car unless the tax etc has lapsed and in which case they should actually inform the Gardai. Like was said go up to the police station and report your car stolen.

    as for the management company where you not given the details of them when you bought your place? if you're renting then your landlord would have the details.

    What's the name of your estate? maybe do a search on CRO.ie for your estate name as a company name. most management companies are listed like that. that will give the registered address of the management company, probably the developers solicitor. Call them, they should be able to provide th details of the management Agent who are the people responsible for carrying out the works in the estate these are the guys you should be looking for if FCC say they have nothing to do with it.

    if the management agent have removed the car and the plates are on it and so on then I'd kick up and have what ever twat that authorized its removal fired.

    The details of the management company will be on your Service Charge demand. In general the management company is usually the name of the estate. Say for example you live in Joe Bloggs Estate, the management company would be Joe Bloggs Estate Management Company Limited. You can then do a companies office search (go on to CRO.ie) and find out who the directors are and contact them directly. As a matter of interest, do you know where your car is?

    The management companies usually have their a$$es covered in situations like this, ie they've got the right to keep the common areas clear and in a decent condition. So if it looked like there were two abandoned vehicles parked on the common areas they can remove them.

    It would be worth following it up though. I would kick a$$ about it anyway.
