Contract Signing

    Quick question, wondering if someone might have some advice..

    if you sign accept a new position in a company and sign contract, but then hand in notice to current employer but then after counter offer from current (which was totally out of blue) dont want to leave, what way does that work given the fact the contract has been signed for other company?

    I assume u can still not take the job but is there anything legal etc the other company could hold against you?

    Just a bit a disaster and some redmist has landed myself in above situation, jumped the gun a bit and signed contracts for new job but probably done it too quickly!!

    The company you are letting down could sue you for breach of contract. If they have had to pay a commission to a recruitment agency for you, and will have to pay again, as well as start recruiting, they might be annoyed enough to do so.

    I wouldn't get too annoyed about 'jumping the gun'. Most of the time you will be better off signing the contract prior to giving notice. I've seen enough situations where people have handed in their notice and turned down the better pay offer only to find the contract fail to materialise to prefer the safer approach.

    I would suggest that most companies would just get annoyed with you, say some nasty things then cut their losses and re-advertise the position.

    cheers, kinda guessed that, thing that has happened though is they are moving office ( was mentioned in interview ). I was talking about on diff thread in here but basically will involve a really long, awkward commute that i dont think i thought through properly, even though would like the job, still have my quality of life to think of and best to tell them now rather than 6 months down the line that it will be an issue..

    I doubt they'd bother suing you. They/the recruitment agency will probably be very very annoyed, but in reality for time and money's sake they'll just cut their losses with you. I did it once through an agency and it was not at all pleasant let me tell you!

    Are you really sure you want to stay in your own job though? Money is rarely the only reason people start looking elsewhere.
