planning-refused due to state of (council owned) access rd

    hi there - we just got word from our councillor that were about to be refused because the planner considered the road to the site in unacceptable condition. (all that rain in past coupla weeks did us no favours on that score!) it's true its not great cos only 4 farmers use that rd right now & we'd be the first house on the rd & we knew we would have to do some work on the road ourselves when we build. no worries. however the road IS officially a council road so can they really refuse pp because they dont maintain the road? anyone experience similar & were you able to get round it?

    If the refusal hasn't got to the written stage yet you should look for the councillor to set up a meeting with the planner and get him to attend also. You can offer to make a contribution (well you'd have to in any event) towards the upgrading of the road. Maybe you could get your architect/agent to look for an extension of time on the application so as to give you some time to come up with ideas for resolving the issue.

    You could ask the cllr. concerned if its possible to get a L.I.S grant paid on the road.

    Edit: The LIS grant wont apply if its a public road

    pretty much along the lines of what muffler said...

    looks like the council don't want to give planning on the road as that would have implications for them in relation to maintenance of the road etc. As muffler said, try and organise a meeting so you can discuss this issue. I am away of one self-build where the site owner voluntereed to surface the road himself (road was in a terrible state) but not sure how this works on an ongoing basis..

    cheers. cllr & arch applied & got an extension to come up with a arguement or proposal from us. exactly as you say the cllr is getting the rd engineer out to assess what needs to be done & then we decide if we propose to fix the road or contribute. suppose it depends on eng verdict & how much it would cost on whether we'd do it all ourselves or apply for a council contribution. Yeh it is a public road alright but just currently used by ramblers & 3 or 4 farmers who have land off it. All I can say is thank goodness we got councillor involved otherwise we would already be refused & to be fair he seems to be doing his best for us.
