Bet out of turn, pot calculation

    PLO game with SB = BB = 1.

    Before UTG player acts, UTG+1 calls out of turn. Of course UTG+1's call has to stay in. What is the maximum raise for the UTG player? 4 or 5?

    It is 5. This came up before in the Fitz when Luke was there and the ruling (as Phil the dealer was doing anyhow) was to include the out of turn bet in the pot.

    This was my recollection too, but the ruling last night was different. I can see that deciding that it counts might be problematic. What if UTG+2 and UTG+3 also call thinking now that the action has passed to them... do their calls also count in calcuating the pot?

    I know there is some sort of onus on the player who has not acted to notify the dealer that he has not acted. Luke removed someones option to raise one night based on this (I think) when he said nothing til everyone else had acted after him. If it is clearly up to one person and the dealer knows this then in my opinion then any out of turn acts are in the pot. I'd imagine that whoever gave this ruling (don't need names) cared less about the proper ruling (which they probably didn't have a definitive idea of anyhow) and gave the ruling that made sense to them.

    Take a post flop example. Pot of 100, 3 players to the flop. Player B bets 75 out of turn. I don't think in this instance that player A should be limited to either check or bet 100 (pot before flop option).
