Compensation from slow builder

    I am in the process of getting a kitchen extension and attic conversion done. The problem is that the job was scheduled to be 7-8 weeks but has now run for 17 weeks.

    Foolishly on my part I never put an compensation clauses into the initial agreement, all I really have is a breakdown of costs for the work.

    The builder has given me every excuse under the sun at this stage, he has been sick, he's had unbelievable problems sourcing supplies, his 2 children have fallen seriously ill at different points etc. etc.

    He has another job which has recently started which he claims he's been hardly been on himself but I'm pretty sure he has. The one thing I did do was to ensure I withheld 20% of the cost until completion.

    They really only have a few days work to finish, some skirting needs replacing, some appliance need fitting, alarm sensors adding, and they have broken the heating in the house (they've claimed to have it fixed now on 3 occasions) and a few other bits and pieces.

    My question if I start taking €500 a day off his final bill after the end of this week how am I fixed legally? Has anybody done similar?
