    Recently decided to update my phone, so as I have done before I look seached through ebay and found the one that a wanted. It was £350 with postage, it was a buy it now, the sell looked ok, had +100 feedback with 99% good, the 1% was some guy who didn’t get his item but the seller had replied that he refunded the money. This guy had a shop and all that, so he had 7 of these phones for sale, As 5 had already been purchased, I went and clicked on the buy it now, it required an immediate payment through paypal which was ok, so I tried to complete the transaction but it kept erroring out saying payment not complete.

    I have had been having problems with me so I contacted seller in relation to this issues and he said that if I could pay him direct, so which I did, he gave me his paypal email address, and I sent him the payment through paypal. Sent him a mail and he confirmed payment and told me he’d ship the phone after the bank holiday weekend, so that was fine, on the thursday I sent him a mail requesting tracking code for the parcel. No reply, over the weekend I still got no reply so on the Sunday, 9 days after I send the money, I made a complaint to paypal. From the complaint center in paypal, it stated that if the seller does not respond with in a certain time frame that the issues would be resolved in my favour. I had no problem with canceling the claim if the seller could send me proof that he posted the phone. With this I decided to do another purchase, as I said in my mind that if the seller is fraudulent, I’d get my money back, and if he was genuine I could sell the phone on, so searched again and found another guy, had a shop, had a history of selling phones etc etc. So bid on the phone and won the auction.

    The auction also stated that it would take 21days to receive item. I didn’t mind as when I bought on line before it took that length of time anyway. So paid for the phone, same money again £350. In the mean time my resolution from my previous transaction had come through and I only got back £105. This pissed me off and I called paypal and was talking to some guy that said that they were looking into the claim and that I should get back my money but it would take time, he also informed me about paypal protection and to buy from ppl with the paypal symbol and with a symbol of a shield that they have protection up to £500. So I also contacted my Credit card company and they stated that they could not cancel the process as paypal has in their terms and conditions that they are not responsible and the credit card company said they cannot recall the money.
    In the mean time about 13days passed and I receive a notification from ebay saying that the guy I bough the phone from (the second phone) was fraudulent, if I have not made payment, don’t, if I have file a claim in paypal. Which I did and that claim has come through and I have received back £105. That’s me with a loss of £490 all this is sterling, which is over €700 I have lost out.
    I have now been severely turned away from buying online as I though that you would be protect by paypal.
    How can these ppl get away with this. Surely they can be traced. Surely they had the money lodged into their bank accounts ect????? Had a look at the first guys feedback recently and they has received +20 neg feedback, there was a lot of money there that he scammed.
    I also went to the garda, but there is really nothing they can do as this is in the UK r something. But I filed a complaint for both problems.
    So my question here is really will I get back any more of my money?

    In short, paid £350 for a phone - guy was a scammer got only £105 back from paypal went i esculated the claim for a refund.
    In the mean time bought a second phone again, another scammer, got £105 refund from paypal. I am out £490. Will i get the rest of my money back? I though that paypal would be secure, but obviously not.

    Eventually, yes. In cases like above the seller will usually have their account limited and the only way to get it back is to refund the buyers. You will find that the refunds of £105.00 which you have received so far have been paid to you by PayPal and PayPal will now be trying to recover the rest of the funds from the seller.

    with all due respect to paypal, i think it is the most unsecure way of paying in the fact that it fools all buyers with the ad "the secure way of paying".
    the fact that you got that amount of money back is more than likely due to the fact that the account to which you sent the money too was not verified so the max protection that paypal can offer is 200$ minus some processin fee.
    paypal covers themselves up sayin they will try everything possible to recover the funds, but that will only happen if the seller adds funds in his account and since he was fraudolent ,i doubt thats gonna happen..
    in future pay only trough the paypal email at the end of an ebay auction and ONLY is if says that you are protected upto 500 euro which proves that the seller paypal account is verified.

    Did this a week ago and they gave me some speal about that within paypals terms and conditions that they cannot do a claim back. So was talking to the credit card company today, And got the same story, but he did say that they would try to do a claim back for me, I had to send them all my email's to the sellers involved.
    So did that, and posted it to them today. Hopefully they can do something.
    I'll keep yee posted on my progress...
