Is there any legal weight behind taking holidays in lieu of notice? I know they have to pay you for them but time is worth more then mony as the tax man cannt take time off you!

No. It's not legislated for. The use of your holidays in lieu of notice is entirely between you and your employer.

If you have a contract check it. The last place I worked stipulated you could not take any annual leave as part of your notice period.
