I bought this item. I paid straight away and today I received an email saying it was out of stock and on back order. Question is what the hell is he doing selling stuff that he does not have? Can I do anything about it other than wait.

He has already given me positive feedback, so can I neg feedback him safely?

    Thanks
    007

Give him a week to dispatch and then lauch a dispute and keep in constant touch with the seller.

theres a lot of time wasters on ebay these days.its becoming unworkable, recently i had someone bidding on an auction , won the item and promptly unregged themselves. pain in the ring

Yep, but get your money back first. Some sellers will refuse to deal with you after leaving a negative. If this does happen though, go straight to Paypal dispute and escalate to a claim.

I take it what he is doing is against ebay rules?

Did you ring them ? I see they are based in Jersey. Should'nt be dodgy IMO.

The page also clearly states that the item is "In Stock" so I dont think you should have much trouble getting your money back, try a paypal claim against him and report him to ebay, also contact him directly notifying him of your intent to report him and await and see if he gives you a prompt reply...

Can he retract the positive feedback if I go the dispute way?

No, feedback cannot be removed by the seller afterwards.

wait at least 7 days, if you dont hear anything, ring the guy...go to the advanced search (top right of most ebay pages) then request member contact info...

if you cant get through - report them to eBay, then file an item not received/significantly not as described dispute.... this more than likely will put the heebee jeebees up him an he'll either give you a refund or issue a replacement.

if you paid by paypal go to paypal.com then resolution centre.. if you paid by cheque/postal order.. go to my eBay, then dispute console.

Its against eBay policy to 'run out of stock'. so you can report him to eBay (use the Safety Centre link on teh homepage)

leave negative feedback as a last resort.. its more than likely he'll retaliate with a negative follow up comment which wont look gtreat on your profile :(

    hope this helps :D

He has already given me positive feedback.

Anyways I challenged him by email today. 1 hour later he emailed to say it was shipped and then a further hour later he emailed saying it would take a week to get more in and he would refund me if I wanted. Question is did he actually ship the item?

It is a bit strange but he is a powerseller so I would be suprised at poor antics from a power seller.
    Wait a week and see.

I wouldnt worry. He is a powerseller who uses buy it nows. These guys list 100's of things at a time, estimating they are going to sell say 50% before the time runs out. If they sell more than expected they run out. Most would not bother to say it is not in stock, they would just wait until their next batch arrives and send it then. They do not want to hold high stock especially of stuff that is dropping in value all the time.
