Important Notice for Passenger and Goods Vehicle Owners and Drivers

    Changes to Tachograph Rules

This is an important notice of changes in relation to the application of tachograph rules and the scope of exemption and national derogations. The new rules make a number of modifications to the existing rules for driver’s hour’s limits, minimum break and rest periods and the categories of operations which are exempted from tachograph rules. There are a number of operations which now come within the scope of the Regulation for the first time.

The changes arise as a consequence of Regulation (EC) 561/2006 on the harmonisation of certain social legislation relating to road transport and amending Council Regulations (EEC) No. 3821/85 and repealing Council Regulations (EEC) 3820/85.

The new Regulation applies to the carriage by road:-

    (a) of goods where the maximum permissible mass of the vehicle, including any trailers, or semi-trailer, exceeds 3.5 tonnes, or

    (b) of passengers by vehicles which are constructed or permanently adapted for carrying more than nine persons including the driver, and are intended for that purpose.

The new rules come into effect from 11 April 2007

Owners and operators of vehicles should consult the guidance notes below for details on the changes
