    Hi all

    I started a new job 3 weeks ago, while I had reservations about it I took it, money was good and great experience for me. Since i started I have become aware of a siutation here in work. Its about work its self. I am an MCSE and I maintain their windows based network and applications. All sounds good, but Ihave no contract yet, we have wage discussions before hand and I think I may be stung on that. I am also on call, but I have to use my own mobile, and buy myself a laptop.

    Any advise? I know I should say something but the agency who got me the job would be annoyed coz I;ve not taking other jobs before.

    Did you ask them for money in order to purchase said items? Or the company visa or will you ask the shop you buy the products to send the invoice to your company.
    Did you say any of the above when they suggested you buy the items?

    So what? I wouldn't give a flying fuk what any agency thought. If the job wasn't what you were led to believe, then go looking for another one. The agency is only worried about one thing, their bottom line and commission. Not your problem.

    How do you expect to get paid??

    You need to sort this ASAP, go to either your direct manager or HR manager

    Explain that you have not received a contract. Explain that you had to buy the stuff yourself tell them you want it resolved immediately.

    A direct approach is best here. Go straight to whoever it is you report to. Explain your situation and request that it be sorted out as soon as possible. I can only imagine it is an oversight that it has not been sorted thus far and you will receive a positive response.

    You need to approach your employer and the agency to sort these issues immediately.

    Odds are your employer will pay the agency and you'll be paid by the agency but starting a job with no contract signed is a bad idea and you need to fix it asap.

    As for the agency being cranky about you not taking previous jobs screw them there getting because of your work and you are the one who is doing the job not them and you did the right thing in picking a job you wanted.

    You need to sort this asap as above, feck the agency and the employer its your life!! You should have had all this stuff sorted out for you and it hasnt been so its your right to get everything the way you want it.

    If not, move on! Theres plenty of jobs out there for you!

    First off, there is one big thing you'll need to clear up before we can give you a proper answer.

    1. Are you working directly for the company or the agency? Or are you working for yourself, "contracting" for the company?

    Quite often, if contracting, agencies will take an administration fee from you for doing your taxes. If this is the case, you are working for yourself. You are not obliged to pay the agency anything. Often, it's the agency who owns the contract from the company, and they sub-contract it to you. If this is the case, you bill the agency directly. If you're contracted directly to the company, then you can ignore the agency, you don't need them any more.

    If you're working directly for the company, that changes everything.

    We'll really need more info before we can offer any more advice.

    On starting a job a written statement of terms should be given to the employee. This should be done within two months of the date of commencement of the employment. If it is not done the employee can complain to a rights commissioner and will be given four weeks wages without proof of actual damage. Look at the Terms of Employment Act 1994. An employee should also be re-imbursed for any out of pocket expenses incurred on behalf of the employer. A careful record should be kept and if they are not paid a referral to the rights commissioner should be made. Even if there is an attempt to describe the employee as an independent contractor it may still be held that the relationship is one of employment if the circumstances so indicate.

    An agency are there for whats best for THEM, be cautious dealing with them and always ask for the contract beforehand to verify everythings right, remember the agent is under pressure to perform just as much as you and will do everything in his or she's power to talk you round. As for buying your own laptop for work purposes - screw that, no ffing way
