    Folks whats the going rate for a single photo to be used commercially?

    Roughly like?

    Also hello everyone, I used to post here a bit until I pretty much photo-hibernated!! Back shooting again though, as things warm/dry up!

    What type of sale would it be - single use? who keeps the rights to the photo? what's the company? etc etc!

    They broke copyright by using it in the first place.

    I would imagine you are in a really strong position so squeeze them for everything you can!

    I would calculate the price based on the fact that they used it first without your permission. I reckon that alone is worth 4/500 euros depending on how many times it was used. Then I'd work out a usage based fee, assuming you're not willing to sell the rights to the photo. Maybe an extra 1000 or so to sell them the rights.

    Then when they tell you to **** off, revise the price downward slightly to make them think theyre getting a better deal :D

    Ah jaysus, Im not a complete bandit.

    Im really not out to punish them for using it or anything, in all fairness its a tiny image on a single page of their website. And I was happy to see it there.

    I mean how much would it cost to hire a photographer for a day to shoot a business? how many pics would he produce and on what basis would he sell them?

    A single photo cant be worth more than 100 surely???

    dundhoone, the fact they have already used it has you in a very strong bargaining position... I would estimate 600+ as a starter and then bargain. If it was me i would say 500 euros and free admission for 2 ppl for a yr.! why not..

    Fact is, they'll probably be lazy and give you whatever you ask (within reason of course). I tend to do what you're doing - undervalue my work - but what you have to remember is its a business with all sorts of outgoings much bigger than you'd imagine and they'll claim it back in taxes anyway so it really doesn't matter (again, within reason). They won't want to have to re-design the page. Too much hassle.

    I have no idea what you should ask. 300 seems fair? You might have to start higher?

    Ask who put your image there.. and where they got it. I wonder - the site doesn't look professionally designed to me. It can't have been when they go nicking stuff!

    What would they do to you if they caught you in the cinema with the video camera recording on eof their films. Be firm and explain the situation and present a price of what you think is fair. if this happens in the States the first they hear of it is in a Legal letter, then comes the punitive damages.

    really? it's relatively common, i thought. i know someone who had 10 or 20 images lifted from his site, by different sites. he invoiced them, and those who ignored the inovice were sent a solicitor's letter and a new invoice with the charge doubled.
    he was laughing that if he'd set up a charging system on his site, these people would have never bought them in the first place, and he wouldn't have made any money.

    Nah - I may or may not have lifted images from istockphoto and the like and manipulated them so they're unrecognisable (whistles...), but I would never blatantly steal something. Its too much hassle as afore-mentioned. Clients usually don't want the legal issues.
