Garage too high - planning query

    Hi,



    I am coming to the end of my self build but have not applied for the cert of compliance as I haven't done fense, taring, piers and kerbing. I have built a small garage which was not on plans and assumed it was fine as I did not go over the 25 sq m floor area limit but I think there may be a height restriction too. The garage is about 5m high.



    I have no plans on selling the house so would it be best to wait until planning is not required as I think if it is present for longer than 5 years planning is not required or should I apply for retention now?

    First of all you do need planning for the garage. Secondly there is no such thing as it not needing planning after 5 years - what the time limit factor is the time that the Council have to contact you about it. If they dont all it means is that they cant take any enforcement proceedings against you but your garage would still be classed as unauthorised development and would obviously be a problem if ever you wished to sell or remortgage.

    You may not get a cert. of compliance now in respect of the house on account of the garage - its up to whoever you have retained for this purpose as to whether they are prepared to sign off on it or not.

    My advice is to make an application for retention sooner rather than later

    You didn't need planning for the garage. It's exempted development...until you went over the 4 meter height unfortunately.

    Talk to the planning office and explain the situation..you don't have to give your name.

    From planning guidelines...
    7. Can I build a garage?
    You can build a garage, carport, shed, greenhouse, kennel
    for domestic pets etc., as long as it does not extend out in
    front of the building line of the house and does not exceed 4
    metres in height, (if it has a tiled or slated pitched roof), or 3
    metres (if it has any other roof type). The floor area
    limitation for exempted development is 25 square metres.
    The structure may not be lived in, used for commercial
    purposes or for keeping pigs, poultry, pigeons, ponies or
    horses. Garages, sheds etc. to the side of the house must
    match the finish of the house. You cannot reduce the open
    private space, reserved exclusively for the use of the
    occupants of the house, at the side or rear of the house
    below 25 square metres.
