Just to lighten the mood here a little. Wicklow Co. Council refused permission for a dwelling with one of the reasons being "sheep from the neighbouring field could jump in the windows".

    What do you all think?

I did laugh but now i'm thinking,

    WTF?

This sort of thing makes an ass out of the local planning authority, someone deserves the sack !

Maybe the applicant should state that he regards sheep as a sacred animal that is welcome in his dwelling...

Just to clarify the Council refused retention for windows that the guy added to his house after it was built.

The house is built but the guy (a professor) added in three windows overlooking a neighbour’s field and the neighbour appealed the retention and won.

Does anybody know the names of the parties involved as we get can the report from An Bord Pleanala online and see the facts of the story.

did it go to the board?

the guy building could of got a doctors cert ot say that his had a sleep disorder and that the sheep jumping through the window would aid his sleep as he lay in bed counting them

And the farmer may counter by saying he has a sheep disorder

Ewe never know what the planners are going to come out with - a typical planning reason for a refusal

I have the full facts of this matter now. Crazy. I hope the NRA don't get hold of this or they will close every road in the country in case sheep jump over hedges.

It was in the paper on Monday. The home owner put in a few new windows and the neighbouring farmer objected. Retention permission was sought from Wicklow Co. Council and was approved. The farmer appealed to An Bord Pleanala who upheld the appeal based on the bouncing sheep. F*ck me.

    From the Indo - 20/03/2007

Risk of woolly jumpers forces professor to block windows

WE are all familiar with spring lamb, but notions about high-jumping sheep or flying cows will go straight over most people's heads.

So it was with a mixture of incredulity and annoyance that retired university professor Harold Harrison heard he had been refused planning permission to keep three windows in his Co Wicklow home because livestock in the next field might run into them.

An Bord Pleanala had refused permission to retain three windows at the house at Killiskey, Ashford, Co Wicklow. The planners were not impressed that the glass was toughened and the windows were as high as a field gate.

    Disbelief

"My first reaction was one of complete disbelief," said Professor Harold Harrison from his home yesterday.

"I'm a technical man, and that anyone trained in a technical subject could come to such a conclusion just beggars belief.

"It's not even cattle that are in the field, it's sheep, so it's ridiculous. I don't think any reasonable person can think these windows could be dangerous to sheep as they are 1.2 metres off the ground."

The windows were boarded up after Wicklow Co Council refused an application for retaining them following an objection by the owner of the adjoining field, who was concerned about the risk to livestock.

Prof Harrison's architect appealed to An Bord Pleanala, saying the existing windows did not give adequate light or ventilation as required under the building regulations.

"The windows are blocked up. It means that the dining room is much darker than it should be so the lights are turned on all the time," Prof Harrison said. "The other window, one of two windows in what we call the boot room - it's where my wife has all her machinery - is completely dark at one end and to do anything the light has to be on."

Alan Yarwood, the planning inspector who dealt with the appeal, recommended that planning permission be granted.

"Animals being pursued could be inclined to jump through a window in the mistaken belief that it provided an escape route," Mr Yarwood reported. "But, given that the sill level of the windows would be similar to a field gate, this seems highly unlikely.

"It is my view that the council's original objective . . . could equally be achieved by requiring obscure glazing using toughened glass; a requirement that the windows should not open outwards; and the provision of external window bars."

However, the three-member board of An Bord Pleanala that dealt with the case refused the appeal, finding that the three windows would "negatively impact on the amenity and agricultural use of the adjoining field".

Prof Harrison said he did not have plans for another appeal "at this point".

As usual there is two sides to every story.

If you look at wicklow.ie planning and read the Bord Pleanala report you will see that the same house had to apply for retention for an extension back in 2001 which specifically stated that windows should not be put there. If your going to flout the laws and just build and look for retention afterwards then you will have to face the consequences.

The thread is humorous and not for detailed analysis of a planning application.

    Lighten up :D

Well, I've not had cows jumping through windows but have had them eating the house!! after a neighbouring farmer didn't look after his fences properly.

Considering the amount of threads moved in Construction & Self Building & Architecture & Planning it's a wonder this one didn't get moved to humor.

We have a very active and helpful Gardening/DIY forum here. When this forum was first created, we knew that there was going to be a bit of moving done and this has proven to be the case. The threads that we move are more suitable to Gardening/DIY than to this forum. Bear in mind that this forum is mainly to do with the planning process and the construction process thereafter. Anybody looking for information on laying a wooden floor or what paint to use etc. etc. will have their thread moved.

Regarding this particular thread, I started it and I made it clear that it was a bit light-hearted. It also is particularly relevant in that it highlights an absolutely ridiculous reason given by An Bord Pleanala in the case in question.

As Muffler has already pointed out, if you are not happy with this then feel free to post in feedback.
