PayPal - paying by credit card - BOI say no chargebacks allowed?

    Hi,

    Contacted BOI about a recent PayPal transaction paid by credit card. Goods were faulty (seller knew, but claimed 100% ok) - PayPal wont touch it (as usual), so called BOI to initiate a chargeback. BOI say that they cannot charge back against PayPal - this is not correct in my opinion - can anyone offer any advice?

    Why won't paypal get involved? Did you wait too long?

    They probably won't get involved as Paypal are not a business as such, they only handle the transfer of money between people. A chargeback would result in them loosing out, not the eBay seller. This is why Paypal should get involved in the dispute.

    Not sure if you know this, but PayPal will only allow claims if you don't receive goods - i.e. if you receive a concrete block in a box instead of what you ordered, that's it. As soon as you open a dispute/claim for "goods significantly not as described" (I think that was the description), they just auto-close it, and say they are not responsible. I was shocked, but other forum users out there report the same situation. Effectively, the buyer loses out, PayPal washes their hands of it, and even your credit card does not provide any recourse.

    I don't know where you got your information, but it's simply wrong. I ordered a DVD box set a little while back and it was significantly not as described. The set was 2nd hand when described as new, the DVDs were covered in dirt as was the inside of the box. Started a dispute in Paypal and got a refund after sending the set back to the seller.

    BOI can, but just don't want to, do a chargeback.

    My information is direct from PayPal, and it is fact. Take any dispute where the seller does not respond, and then escalate it to a claim on the basis of goods (not eBay) "significantly not as described" - result: automated closure of the claim, as your are not covered for goods "significantly not as described". This is exactly what happens and is not "simply wrong"

    You are incorrect and jor el is correct
    As a seller on eBay, I can assure you, there is NO auto closure if the seller replies. They fully investigate the matter and decide based on info given to them. I have both won and lost cases with this type of claim

    And to answer the initial post, Bank of Ireland are obliged to process a chargeback for you if the goods are not received as described, whether its online or walking into a shop! It can take up to almost 2 months sometimes, but they should do it for you. Kick up murder :D

    Nope its not fact, you are just slightly confused with the process.

    If you buy an item on ebay and pay for it with paypal in the correct way i.e marking the payment as a payment for an ebay auction then yes you can file a claim for a significantly not as described item.

    If you just send a payment to a seller, paypal has no way of knowing if it was for an ebay auction or for something else entirely. You may still file a claim on that transaction but it will be closed by paypal if its not resolved between you and the seller.

    Put quite simply, paypal does not address claims for significantly not as described items if they are not purchased on ebay. You should brush up on the user agreement ;)
