barred from a club

    Hi,

    I have a query for you. I have been barred from a nightclub. It happened a couple of weeks ago on a sunday night. It was rag week and I was extremely drunk, don't even know what I did to get kicked out! But after I was turned away initially I managed to gain entry through a service door illegally and after that I was kicked out. I was in there for bout an hour but can't remember what I did in there. I'm guessing he just saw me in there and thought How did this guy get in?
    So I tried to enter the same club two nights later on tuesday night and the bouncer said "no you're not coming in", I asked why he said "cos you're a bold f***er". Ok I said, what did I do? I asked, he said " you know right well what you did", he wouldn't tell me, all he said was "ask a guard about the equal status act 2000". So I'm asking you guys, whats this about?
    I tried to go in on saturday night and he wouldn't let me. As I want to go to this club again, I need to rectify the situation. I'm considering going down to talk to the management about it during the week.

    It's private property, you have no right to enter. If you feel that the nightclub has failed in its legal duty to provide services to you without discriminating on the basis of age, religion, nationality, sexuality, membership of travelling community, etc, you can sue them in the district court.

    How does that legal duty arise, through the drinks licence? And would that course of action be pursuable for a sports club which didn't have a drinks licence?

    The duty is created by virtue of section 5 of the Equal Status Act 2000

    You can normally complain to the equality authority, which can take a case on your behalf to the equality tribunal, except in the case of a licensed establishment where by virtue of the Intoxicating Liquor Act 2004 you must take the case yourself to the District Court.

    Hmmm. Okay, reading through that's reopened a more general question for me - what is the status of private clubs under Irish law? Do they even have a status?

    If you're clever maybe you could write them a formal letter of apology...might totally throw them off :P

    however you totally screwed yourself over going in the service door: the likelihood is they caught you on camera.

    If you really care get in touch with them and apologise and try to apologise to the bouncer.

    Once you apologise when he isn't on the door he will probably accept your apology.
