Withdrawing Planning App

    Basically I have been told that my planning is going to be refused. The due date was today and my local councillor informed me that I would be better off withdrawing the app as it will cause more hassle when I reapply if I don't.
    I have been told that if I withdraw the app I won't get the full details as to why it is being refused.

    My questions are :
    • Up until when do I have to withdraw the application or is it too late already??
    • Has anyone had this said to them before

    Any help would be great??

    Seems very strange but I'd imagine you'd be better letting the application be fully processed, if only to see the reasons on why it was refused. I would imagine this is the least you'd need to know prior to re-applying..

    i submit applications regularly and have withdrawn a few also.
    I ve been told its better to withdraw because if i apply at a later date the history of the site shows a withdrawal as opposed to a refusal.
    To be honest it doesnt make complete sense to me,but then planning service doesnt make sense anyway.

    If the decision date was today (after midnight so it was yesterday) it would be too late to withdraw it. I would ring the planning office first thing in the morning to see if you still have time to withdraw. It only takes a short letter saying simply you wish to withdraw it.

    If it is refused and you reapply the refusal shows up as mark on the copy book so to speak. in some circles its termed bad planning history. What all this means is that if a site has been previously refused then it is more difficult to get it passed the next time round as the original reasons for refusal will be taken into account again as will any other issues that may arise with the introduction of new regs or new development plan requirements.

    You are well advised to withdraw the application - time permitting.

    If you were made aware (before an official decision had been made) that the application was going to be refused then it shouldn't be too difficult to find out the reasons.

    Ok just rang the council there and it cannot be withdrawn so basically I get a black mark against me for reapplying because I want to find out why it got refused - that makes perfect sense!!! Oh what a sensible world we live in....

    I dont understand your point. You are not reapplying to find out why you have been refused. If you reapply you do so in an attempt to get planning. You dont get a black mark for reapplying but you do for getting refused.

    If you have been refused you will or would have got official correspondence confirming the refusal and giving the reasons for same.

    Im a bit baffled at your post

    Sorry I just read through the post myself there and it is a bit confusing, what I was trying to say was that I find it hard to believe that it is a bad thing to leave the application finish out, if I don't leave it finish I won't have the exact reasons for why it is being refused. But if I withdrew it I would only have what I have heard from my councillor.

    I think what you are trying to say is that if you withdraw your application you will never know why it was going to be refused - at least I think thats what you meant.

    Bear in mind that it is illegal for anyone to tell you what decision a Planning Authority is going to come to before they issue it in writing. Effectively you have been tipped of as to what way the planners are going to determine your application and if that being the case you would or should have been made aware of the reason or reasons behind that determination.

    I thought you were out of time at this stage

    Also - it if you think about it you can see why it is better withdrawing.

    A lot of Irish planning can be down to the individual planners - especially with marginal one off housing. Beauty is in the eyes of the beholder...... one mans meat another mans poison etc etc!!

    If there is a refusal on a site - then another planner (ie a colleague of the person who originally reviewed the application) is going to have to consider if he will overrule his colleague - it would always be easier to refuse it..... safer than sorry.

    I am not saying that this is right - just the way that it works.

    Also - a lot of CC's insist on the same planner for subsequent applications. If it is withdrawn then a new planner can be appointed. Otherwise you have to get by the original guy wo refused you first time around!
