Quick question about under 18 breaks.

    Hey guys,
    Kinda confused about something here, hope you can help. The law is that every person 16 or 17 in employment is entitled to a half hour break every 4 1/2 hours, correct?
    So if said young person is in work from 12-9, a total of 9 hours. Are they entitled to just a half hour? As 4 1/2 hours, plus a half hour break would leave just four hours left. So no break entitlement?
    Or is it - they're in work for 9 hours, two 4 1/2 hour periods, so a break of 1 hour is due?

    Won't bother with reasoning behind it unless it's needed. Thanks in advance. :)

    The way it was always explained to me when I was 18 - so forgive me if this is blurry - is you work for 4.5 hours - break for half an hour - work for another 4.5 hours - no break as you are then leaving.

    Technically its you cannot work for MORE than 4.5 hours without a half hour break. So, you get your break after 4.5, and clock out after another 4.5.

    The general rule on breaks is that you are entitled to a break of 15 minutes after a 4 ½ hour work period and a further break of 15 minutes after a 6 hour work period. There is no entitlement to be paid during these breaks.

    Most companies simply provide a 30 minute unpaid break at some point in the middle of the day. The work periods don't have to be unbroken, just within the same day.

    Thanks guys, still hazy on it. I think the half hour break is correct. Though in reading that Citezen Info site -
    Shop employees who work more than six hours and whose hours of work include 11.30am - 2.30pm are entitled to a one hour consecutive break which must occur during those hours. Employees who work in the Retail Grocery trade (Nationwide) and the Retail Footwear and Drapery Trade (Dublin only) are entitled to a 15 minute paid break (exclusive of the main meal break) if working more than four and a half fours.

    Which leads my situation to more confusion. Anyway, thanks for the replies. :)

    You should have stated in you opening post that it was a shop job as shop staff entitlements are different as you have found out yourself.
