    ok i was bidding for this item here and unfortualately i was outbidded (plus i didn't want to go crazy amounts :D).

    now an hour after the auction ended i get an email from this guy saying this:
    [FONT=Arial, Verdana]I have the same Biffy Clyro item, I can send you scan with your name/date/time etc. for proof. If interested, e-mail: ebaynw1.sales[at]googlemail.com Thanks.[/FONT]

    i've never encounted this on ebay before, his feedback/location/how long he's been with ebay looks good but i was a tad put off by him asking me to email him directly.

    the message came through ebay, so should i email back or hit the respond now button and respond through ebay?

    anyone know if this is common practice?

    he's now emailed me back with this...
    Scans attached with your name, date/approx time.
    I don't want to list this on ebay to risk VERO/suspension
    as record companies are getting very hardcore about such items.

    I would sell this for 26 UK pounds which is slap bang in the middle of what you bid.
    Postage 2.50 RECORDED delivery to protect you & me/avoids loss/theft etc.

    2nd Chance offerings are common enough, but they have to be done through eBay using the official channels they provide. This seems to be a private sale with you sending him money (and not even the amount you bid) and relying on him to send on the goods.

    Just re-reading your post, this offer is from a different guy all together is it, not the original seller? That's well dodgy, you should steer clear. I can't find an eBay user called nw1sales either.

    yeah it's a different seller.

    if it was the orignal seller i would of went for it, maybe even went with this guy if he was willing to put it on ebay.

    Not neccesarily a scam, but he is trying to avoid Ebay fees. Looking at his feedback, he seems excellent, although what he is doing is "technically" a breach of ebay regulations

    Tell him to list it and mail you the URL immediately and you can purchase it and he doesnt have to be worried about whther his auction is pulled or not as you will buy it right away.

    That way you are covered for a refund etc if there is any problem. Only thing is, he might want to increase the price if he is listing on ebay to cover his listing fees and final value fee also
