If a tree falls in a housing estate?

    Tom and Mary are neighbours. On the border of their property which is open plan there is a mature tree. In a high wind the tree falls over into Tom's garden. On examining the stump Tom realises that the stumpt is in Mary's garden.

    What are Mary's liabilities (if any).
