hotel conning worker

    A friend of mine was ofered a 6 month job with a hotel.At the interview she was asked could she work over christmas as it was a condition of employment.
    she worked all the hours she was asked to over the holidays and then was let go with one days pay and no notice.she only started in november and they forgot to give her a contract.She missed all of christmas as her family live in england and she couldn't go home due to work. she is realy pissed off as she now knows that they only wanted someone to do all the days their regular staff wanted off.ie christmas and the new year.Has she any comeback

    Has she anything in writing that will prove it was a 6 month contract?

    EG even a job advert.

    Otherwise the only thing she can do is name and the hotel. However Im not sure whether the mods/admins would appreciate it being done on boards ;)

    Minimum of 7 day notice period to be paid (even with out contract).
    The right to extra pay for the holidays she earned, the extra bonus cash for working the bank holidays (excluding any extra pay for Christmas day/New Years Eve if they had any such scheme) and any shift allowance.

    So in short yes, advice her to take the company to court (if she can back up the 1 day pay only with her payslip etc.) as she's going to win by default on that alone (can't be negotiated away) and probably get a decent compensation through the court (which is why all companies fear being taken to court due to the American style compensation scheme).

    20 days a year (based on 8h day) = 1.67 days a month = 13.3h a month. Divde by a average of 20 working days a month is it indeed an 8.3% extra on top of the salary.

    Please note that she should not do anything until she recieves her final payslip and P45 as these will be crucial for her to have any case.
