The City vs Dublin Bus.

    Eagle eyed observers (Not Dublin Bus Management) have spotted what may well be the opening shots in a power struggle between Dublin City Council and Dublin Bus.

    Shortly afore Christmas,not one but TWO Statutory 3 Tonne Weight Limit signs were erected at the junction of Stillorgan Rd and Beaver Row,
    Since Beaver Row is the ONLY means of access to Dublin Bus`s Donnybrook Garage this new situation now means every Bus entering the Garage is now in Breach of the Road Traffic Act..

    This also entails each Busdriver being in liable for a fine and some penalty points for EACH infringment of the regulations.

    Since there are TWO signs,both predominantly placed on Lamp Standards and neither sign has an "Except Buses" plate this means that the weight limit applies to ALL vehicular traffic using Beaver Row (Including Morton Circle Line route CL2).

    Now that Operation Freeflow is now over for another year I fully expect the Garda Commissioner to deploy increased resources at this junction in order to further reinforce the great success of the latest Operation.......well whatever !

    Mind you it`s an ideal location for a young Garda to seriously improve his/her detection and conviction rate too !!!

    i suspect that this limit doesnt apply to "access"...it is after all only intended to limit through traffic presumably.

    AFAIAW Such derogations as "Access" or "Except Buses" Must be indicated by the appropriate statutory signage.
    This is for example why Bus Lanes are not operational until the Stat Signage goes up.

    The Local Authorities have a substantial Road Signs Manual issued to them by the Dept of the Environment...somebody probably even signed for it.....Whether anybody in the Council actually bothered to read it or not is another issue altogether !! ;)

    There is an exemption for access, although one would have to go searching for the relevant legislation. It wouldn't apply where there are bridge limits though.

    A driver of a truck or bus can ignore a 3 tonne restriction where access is required and no alternative route is available. It happens all over on a daily basis. Many residential areas have restricted access but a refuse truck, removals truck etc. may legally enter.

    Road Traffic (Traffic and Parking) Regulations 1997

    Section 17:

    17. (1) Where traffic sign number RUS 015 is provided at the entrance to a road, the driver of a vehicle, the unladen weight of which exceeds the weight specified on the sign, shall not proceed beyond the sign.

    (2) Sub-article (1) shall not apply where it is necessary for a vehicle to enter a road solely for the purpose of gaining access to or egress from premises accessible only from that road.

    I thought Dept of Transport put up weight limits on roads, not the council?

    AlekSmart, the 18 & 83 go through 3t zones in Rathmines, no stated exemptions. :eek:

    No, only councils own roads.

    Dublin 4 breathes a collective sigh of relief,thanks to Wishbone Ash and their version of that ol R&B classic....Section 17,sub-article 2 of The Road Traffic (Traffic and Parking) Regulations 1897.


    Not so sure about Flatland tho..... :eek:
