Does state have the right to ask banks if an individual holds an account?

    My mother is wondering whether the state has the right to check her bank accounts. Worried that she may not get a full old age pension when her separation is over. Does the state have to right to ask banks as to whether an individual has an account and the details? Alan

    You may want to try in legal discussion to see what her rights are regarding her privacy while banking.

    The answer is yes. In certain cases the state will have the right to ask and to freeze the assets of the account holder. Generally used by the CAB, but I believe it extends beyond the CAB also.

    As mentioned might be better to seek legal advise on this.

    They can only check if you give them written permission. However, if you refuse permission it could be taken that you have something to hide !!!

    This applies to Social Welfare. CAB is adifferent kettle !!!

    Yes, this is correct. If you have savings and don't declare them this can be serious as you would be 'depriving yourself of an income' for means purposes.
