EBAY - Packaging and Postage Issue

    Hi all.

    I have had an issue arise with a seller on EBAY. In short, I purchased an item and paid P & P for next day delivery through FedEx, which would have resulted in my product being received by me last Saturday, December 9th. Although the seller said my goods would come on a weekend, I thought it was more possible that it would arrive on Monday, and I didn't really have an issue with that. I just needed the item to come on Monday. Nevertheless, I had someone be present at my billing address Saturday and Sunday to collect the package should it arrive, and today I remained home in the hopes of it arriving. It didn't arrive and I lost a day's business. I am self employed. I will lose a further day's business tomorrow whilst waiting for the item.

    I had received a confirmation e-mail from the seller on Friday at 2.23PM that stated my item had been shipped. They expressly told me that if the sale was completed before 3PM it would make final shipment out of their warehouse at that time.

    I called today, having wasted a day, and was told that the item had missed final shipment. I explained that this was not my fault, nor my responsibility as I had done everything to fulfill my end of the bargain. I have a confirmation e-mail stating the transaction had been completed at 2.23PM and I had done everything to meet their deadline. I asked why did I pay the next day delivery P & P when I could have just paid normal postage and it would have arrived at the same time? I asked to be refunded the cost of the additional P & P but the seller has declined.

    I must admit I am new to buying online and usually would be willing to put this down as a lesson learnt, but they have infuriated me so much with this that I don't feel like letting this one go. I wonder if those that have experience with this could shed some light on it for me? Is this acceptable on their behalf? Do I actually have a right to request the refund? Is this standard practice in issues like this?

    I hope someone can help me out with some answers. Thanks in advance.

    Hmm, that is a ****ty situation. I know what it's like to wait around all day and not get a service you were expecting. There would be two basic options in this case:

    1. Leave negative feedback
    2. Open an Item Not Received or Significantly Not as Described dispute (considering that you expected by Monday at the latest than you could argue that it was "Significantly Not as Described"). See http://pages.ebay.ie/help/tp/inr-snad-process.html for more info.

    Thanks a million for that. I have fired them off a final e-mail to see if they will come through in the end. I imagine it's overly optimistic but I'll at least give them a chance. Otherwise I will follow the route laid out in that URL.

    Is there a time-zone issue i.e you received the mail at 2.23PM but in their country it was 3.23 or similar ?

    Note ebays definition: "An item is considered "significantly not as described" if the seller clearly misrepresents the item in a way that directly affects its value or usability."

    If you paid with paypal open the dispute there. Opening a dispute on eBay itself is an exercise in futility that will not result in a happy ending for you. eBay's support lies somewhere between useless and non-existant, in my experience anyway.

    Paypal's support can be cruddy but they have resolved disputes for me in the past. Explain in the dispute that you paid for next day delivery and that Fedex have told you the seller did not provide that service to you.
