    Hello, this is my first post and I hope someone can enlighten me. My solicitor sent in a Section 49 Land Application and the she told me this could take up to 18mths. This has already been a very long process to get this far and I was wondering if the new Authority which came into effect on the 4th November would improve this situation. Also the solicitor mentioned that Section 49 applications may have to go to court under new legislation that is coming in..anyone else hear of this?
    (The S49 application was made because we discovered that when my grandfather died, the land his house was on had never been transferred from the original owners name, this was back in the late 1920's) Not seeking legal advice as I have a solicitor but I was wondering if anyone else had been through this process?
    Any help appreciated. Misc

    short answer. it'll take ages; as far as your application is concerned, the *new* authority is merely a name change (windscale->sellafield, anyone!!!) ask your solicitor for the 'dealing number'...that'll at least prove that the application has been lodged...

    Thats what I feared to be honest, 18mths does seem to be the standard reply whoever I ask. it just seems a excessive amount if time. I just had hoped that someone on here had gone through a similar process. I wouldnt mind but it is not a large property with complicated transactions etc attached. I have to say though I got a lot of help from the national archives with locating documents about the original registered owner, they were very good. Misc
