NARGC Rights leaflet

    i got a leaflet in the post about various rights realting to shooting, owning a gun and applying for a licensce. Anyone else get it??

    It very handy has all the Q&A.
    will post some samples of it when i get time could maybe a mod to make a sticky of it.

    Yes, I got mine in the post as well. Very informative I have to agree. I also got a newspaper called "Gameshoot" with it and could not believe the amount of highlighted cases of incompetence, rudeness & ignorance by the Gardaí within the paper to fellow N.A.R.G.C. members. I have it so cushy where I am looking at some of the complaints.

    21. Can the Gardai request that I bring my firearm to the Garda Station to be checked at licence renewal time?
    Yes, the Gardai are perfectly within their rights to periodically check that the details of any firearm held by a private citizen are in accordance with the licence issued and that no firearm has been changed since the last licensing period without the proper procedures being followed. Also, a member of the Gardai may inspect any firearm at any time or place.

    Does this mean that a guard can show up at my house unanounced, with no warrant and ask to see my firearm, ammunition, safe etc?? (not that i have a problem with this , id just like to know if its possible)

    The gardai, however, have the right to inspect the firearm and it's storage. Or will have when the new Act comes into full effect next year. Either way, it's a legal point - the reality is that you put the kettle on when they show up for the cuppa after you've shown them round :D

    The licence lasts for three years after which it must be renewed.

    The phamplet makes some nice reading and is well worth a browse. This is one answered question on the phamplet. It says that the licencing period is for 3 years. My licence is valid for 12 months only. Is this change coming in wih the CJB, and is it currently effective or will it become effective upon renewal next year?

    The pamphlet was written with the assumption that the entire act had been commenced TV, which isn't yet true. Makes sense though - when the entire act is commenced next year, they won't have to change anything. But for now, some parts like the one you mentioned, are wrong, and we don't have any date for when they're going to become right. We have a guess that it'll be early next year, but that's all.

    The list of cases was unbelievable! I'd say a few more cases will start to appear very quickly once NARGC members around the country see excatly what they can complain about.

    3. Can a Garda at the front desk in the Garda Station refuse to accept my application?
    The answer to this question is a definite NO! The Garda receiving your application has no function or authority other than to facilitate your application and pass it on to the Superintendent for decision.

    I'm not sure about this one. I thought on the firearms application form it has to have the local firearms officer or Garda's recommendation from the local station? Therefore if the local firearm's officer or Garda filling out the form sees at that stage the applicant is unsuitable for the application they can recommend against the applicant.

    No Riggser, the local garda can't refuse to accept the application. He can recommend to the super that it be refused, and probably 99.999% of the time it would be; but the local garda can't be the one to make the decision.

    It's a bit of a legal theory point in practise I suspect.
