No Contract, Legal implications for employer

    Hi
    A friend of mine works in a consultancy, producing lots of reports etc..He has no contract despite working there for over a year. I know that its a breach of employers regulations to have staff past 6 months without a contract.
    What i'm wondering is who owns all his work?

    There is no legal obligation for an employer to provide a written contract (althought most do). The fact that your friend is working there is a contract of employment in itself.

    However, under the Terms of Employment (Information) Acts 1994 and 2001 the employer is obliged to provide an employee with a written statement of terms of employment within the first 2 months of the commencement of employment.

    His employer would own the copyright on work that he does in the course of his employment. Only exception would be if he had a contract that specifically specified otherwise (very unusual.)
