A quick question. How is an airline taxed? Is it based onthe number of passengers onboard each flight or is it the same for very plane regardless of numbers on board? If it is the former them surely if you cancel a flight then you should be entitled to the tax back (I'm sure you wouldn't have a leg to stand on if you tried claim the fare). Fair enuf (no pun intenede!!), maybe its written into their rules that they are not refunded but if this is so is it legal?

No need to contact the Revenue at all. Most airlines have procedures to claim back such amounts, but some (such as Aer Lingus and Ryanair) charge an admin fee for doing so, so it may not be worth it many times.
