How does a paypal dispute work ?

    Hi

    I bought a North Face jacket from a seller in the UK with a 100% feedback rating 2 weeks ago. At first glance it seemed to be legit with tags and most of the external stuff. However, having worn it twice I'm pretty sure its a fake for a number of reasons. I contacted Paypal and initiated a dispute outining why I believed the jacket to be a fake.

    I've been involved in outdoor persuits for a while so I think I know what to expect from the clothing. Basically I implied that the seller didn't know that the jacket was a dud because its a pretty decent copy. In the past week I've seen lots of jackets like the one I bought up for auction, which could be a coincidence but.....

    I've just been told that the seller has escalated the dispute to a claim. The seller has given no real reason, just drawn attention to the fact that he has been more active on ebay longer than I have. This is only m second purchase, the first having been a North Face bag which I'm delighted with.

    Does anyone know where this will go from here ? Its not a huge amount of money but I don't want to be stuck with a €100 lemon. :mad:

    If the seller has escalated to a claim then he's trying to refund your money it would seem. A claim takes the format of you returning the goods (by recorded delivery) and then Paypal refund your money when they confirm it has arrived.

    That is the way it looks to me, if you have to send the item back to the seller, make sure it is by recorded delivery or similar and keep the receipt. It does take a while to get through it.

    This is the response the seller has made to the dispute.

    "Hi I beleive this is a fasle claim The buyer is new on ebay only 1 feedback and i have over 500 This transaction is about 1 month old There has been no contact from the buyer in this time to say they were unhappy"

    The transaction is about 10 days old btw and I had contacted him to ask him if the item had been shipped.

    This hardly means he is willing to refund my money? He has 10 days or so to come back with a response. I'm sure it (counterfeit brands) happens often enough on ebay. Any ideas as to my best plan of action if he claims its legit ? There are many differences between the genuine North Face product and the fake jacket that I've been given. :confused:

    unfortunately he doesnt seem to be willing to give u back ur money..
    by escalating to a claim he basically wants to get rid of the matter asap, because the dispute its made to allow u to communicate with the seller
    ( and he has shown that he doesnt want to do that)so by escalating to a claim he s gonna let paypal decide where ur right or he is.
    i dunno really from which point paypal will look at this situation , but if lose you dont get ur money back and if u win and the seller has no money in his acc you ll still wont get anything back.
    of course then paypal will not allow him to use paypal anymore so if hes being a long term seller as he says , then this might not be the case , im saying this just to explain.

    If paypal decides to solve this matter by returning the goods to the seller before
    gettin ur money back, make sure you post it tracked as the others said.

    Sry to troll this but i need some help i put it a dispute for an item that i havent received in 2weeks, the tracking number doesnt work/ the delivery company say its an invalid number, he says he has proof it was sent, Now my question is this "is all he needs as proof the invoice of shipment or does he need proof of delivery"?

    well if u start a claim with paypal they will ask him for the tracking code, which if
    its as u say invalid, then you ll win the claim and hopefully get a refund, depending if the buyer has funds in his account.
    i wouldnt worry about a proof of delivery until paypal recognizes the code to be valid

    also i would escalate the dispute with paypal to a claim, cos otherwise ur just waisting time trying to sort it out with a seller who give u a fake number..
    start the claim and let paypal investigate asap

    he has given me a scan of the invoice and receipt, they look legit i now have his contact details name address and phone number. If i close the dispute and it goes t*ts up could i still get a chargeback through visa ?

    no wait i didnt mean close dispute as such, but close dispute and escalate to claim which is an option u ll see on paypals page.
    dont close it until ur satisfied with the reply paypal will give u at the end of the claim. you would have a chance by contacting visa but to be honest i would start off this claim and see what paypal says.
