Waiting on Suite over 6 mths

    Hi My Mother bought a suite of furniture back in march, she was told delivery would be by the end of April which she was happy with.When they came out with delivery it was the wrong suite.They gave her a spare suite until the correct one was ready which they said it would by the end of June, she accepted this,no sign of suite up to September after many phone calls.They rang her 3 weeks ago today, they said it will be delivered the next day she is still waiting. 3 weeks later. She had to pay the total amount up front, Now she wants to know can she demand her money back when she goes up to them on Saturday if the suite is no there, what can she do Thanks

    of course she can, they will try to BS her but if she stands her ground and raises her voice about waiting 6 months (and the place is busy and them ALL listening) then the manager will cave in pretty quick.

    tell her (knowing the industry)

    1. stay at counter, its a simple request , money back
    2. do not go to office or off to side
    3. do not take any BS about 0% finance or finance companies, there is no contract any more ,100% non performance , and thats that.
    4. do not go in UNTIL they are busy :p
    5. accept no BS about 'head office' here or ESPECIALLY in UK, tell them they took her money, never delivered, never told her anything and they will give it straight back.

    And of course if she goes in roaring and shouting then they will give up straight away. :-) Best to do a full atttack rather than making a meek approach.

    Roaring & shouting will rarely get you anywhere with a retailer. Be polite & firm and have facts with you prior to going in. Inform them that you have located another suite elsewhere which can be delivered immediately and that as they have been unable to complete their contract in a timely manner you are excercising your right to cancel the agreement. - If possible have this typed up with a signature and an order reference number with a copy of the order attached and requesting that the loaned suite be collected.

    Also ensure you have a second person with you.

    Continue being polite and tell them you understand it is not the manager's fault and that you may be looking for other items soon. - At this stage you should have agreement for refund. If you paid by credit card or laser they will refund in this way, if you paid by cheque, they may issue a cheque refund.

    If they do not provide a refund leave the notice of cancellation with the manager and inform him / her that you will be lodging a claim in the small claims court immediately and that the notice of cancellation takes effect immediately and ask them to collect the loaned suite within 10 days. - And then post their name here as a warning to other consumers.

    just going up to the counter and demanding your money back will not work esp if it is one of the corporate firms as even the store manager will need authorisation

    what company is it, i might be able to help you out
