window fitter not working in his propsed timeframe

    ok, there it goes...
    moved into our new house a month ago, the house is a rather old one so bits and pieces to be done. one of the main things: the windows need replacing.
    so found somebody to do the job, guy came out, made reasonable offer and gave reasonable timeframe (windows were supposed to be fitted within the next 3 weeks after order date). that was pretty much the only time he ever contacted us. as soon as he had the order we did not hear from him again unless we call him. 4 weeks on and we still don't even have a date, he keeps telling us he will call back with a date and then doesn't and excuses himself with a backlog due to bad weather and that his kids needed to be brought to school.

    we paid a deposit and he already ordered the windows. can we still decide to go with somebody else given the fact that he is unable to give us a date (thus delaying other work that has to be done in the house as well)?
    in this case, can we claim our deposit back?
    advice very much appreciated!

    how do you know the windows are ordered? I think u are being had.

    without a receipt for the deposit u are in DS.

    Call him. Cancel the job. Ask him to return your deposit within 3 working days If he fails, go to the small claims court. Tell him it's not up for discussion, and you don't care if he ordered the windows, as he has already voided your agreement when he didn't live up to his end of it - simple as.

    Either way, don't get him to do your windows at this stage, as he's obviously incompetent, and this situation can only get worse once (or if) he starts the job! Get out now!

    agree with previous poster, this might actually be good as if he's shoddy then you might end up with el crappo windows, as a side comment if you are going somewhere else, go for engineered windows with argon filled cavity, stronger/better
