    I was working a weekend job in my hometown but had an arrangement with the boss that I could work full-time elsewhere during the summer and would come back to him in September. I didn't get the hours I needed in my full-time job so after much consideration I decided to get a part time job where I'm in college as I needed the money. As soon as I decided this I sent a letter of resignation to my boss in the weekend job which asked for my P45 and my holiday pay.

    That was 3 weeks ago and I have heard nothing. I am about to go on emergency tax in my new job and I can't afford that at all, I'm sure you all know how it is to be a student. I am also totally independent from my parents so that money is all I have.

    Basically I want to know if there is any legal jargon I can threaten my boss with to scare him. This is the second time I have had this happen. In the job before I spent three months trying to get my P45 and holiday pay and there was always some excuse why it wasn't there. I'm not taking s**t this time, the money is owed to me as is the P45 and my understanding is that my boss should request my P45 as soon as I request it. Am I right and what can I do?

    Less rant, more point? It's not entirely clear what you want. As per the charter, if it's legal advice: pay a professional for the advice.
    If you want your P45, and your employer seems to be dragging his heels: you usually get it when you're getting your last pay-cheque (So if you're paid monthly, this would mean waiting), otherwise: get in touch with the tax office, explain: they'll send your previous employer a letter or phone him and he'll move quickly.

    Less rant; I want my employer to give me my P45 and holiday pay and stop messing me around. I didn't know if he was in breach of anything legal and wanted to know if he was.

    I will ring the tax office on Monday, thanks.

    Ring the tax office and put pressure on him from that side. It may also be a good idea to send a registered letter to your previous employer.

    I had planned to ring him on Monday and ask what the story is. I will ring the tax office as well regardless.

    He's a bit of a prick and I have a feeling he won't have passed on the message to the accountant to get my stuff ready. If I find out he hadn't requested my P45 and holiday pay what action should I take?
